I mean that's ridiculous! It's like suggesting a black man could make an unbiased ruling about interracial marriage.

If Jesus himself were ruling in this case, they'd throw a hissy fit and quickly point out he's some faggy long-haired hippy middle-easterner who spent most of his life hanging out in seclusion with a bunch of guys... My concern is the possibility of a mistrial or appeal down the road on the grounds that the judge did not recuse himself from this trial.

Presuming a gay judge will be biased in favor of gay marriage is the same as
Presuming a straight judge will be biased against gay marriage is the same as
Presuming a black judge will be biased in favor of interracial marriage is the same as
Presuming a white judge will be biased against interracial marriage.

The ONLY way they could possibly press this assertion is by admitting that laws about gay marriage have no bearing at all on the lives of straight people. In which case, they've lost their central argument in their attack on gay marriage. They're just squealing and making noise because they know they're losing. This information about the judge has been available for years. With the kind of money on their side, there's no way they didn't know about it well before the trial.

They've just been holding onto it as leverage to use at the end of the case. They believe they can intimidate the judge into ruling in their favor by potentially destroying his career by claiming he was biased in a high profile case. Make life difficult in his home town, make a man who's never taken a strong stand about his life have to run and hide or brave the fire. They're HOPING he will recuse himself now so they can get a different judge that will possibly be more in their favor. They don't WANT the case to go to the next level. 9th circuit hasn't exactly made a lot of extreme right rulings after all. All they're doing is burning a cross on the man's lawn and hoping he'll be afraid of them.
